Introduction

The contract can be compiled orally (Steingold and Steingold, 2009, p. 206), the contract under consideration is a written one. As Putty Sports is a company that needs to hire a person experienced in the area of the network that handles, monitors, and automatically responds to billing and shipping needs, it is necessary to compile a contract that would make this employee stay with the company for a minimum period of 3 (three) years and prevent him/her from disclosing the information about the company’s internal issues, revenue, and strategies to competitors or use it for self-enrichment.

As the job security is one of the most important issues in the employee contract, it is necessary to guarantee that an employee is not affected by an insecure job position (Weiss, 2004, p. 280). So, the contract should have three functions to involve an employee for at least three years: 1) guarantee that a person works for a company for at least three years, in case of an employee leaving the company earlier some penalty provision would be imposed; 2) ensure that an employee does not disclose the information to competitors within the next 3 (three) years after the ending of the contract period; 3) motivate the employee using salary and bonuses imposed for effective performance.

1.
