Any business undertaking a fundamental policy that attends to safety matter ought to consider the ethical perspective for instance smoking, ergonomics, provision of space for other activities and flow of work. Every employee has a right to work in a safe place free from polluted air and enhanced of comfort. In any organisation, effective ethical consideration is key and comes with rejuvenated energy to propel the staff and management into higher levels of productivity. When they have figured out exactly what they are to undertake at every step of their performance. In essence, any form of communication between the enterprise associates is designed to bring improved performance or satisfactory tasks undertaking (or working conditions) to all stakeholders of the company. Such conduct of measures ensures regulated controls and enhances the relationship between the internal stakeholders as well as the external stakeholders.

Working conditions right to a safe work place, employers have a duty to provide a positive working environment. Safety encompasses reduced risks of accidents. According to deontological theory, it is ethical to undertake an activity that has an impact in the health of anybody regardless of the company one is working. On a closer look at the ethical perspective, with regard to privacy ethics at work, it falls that this is, natural moral, law that one may be reluctant to resist. However, the same theory advances that it is an intuition from common sense and one ought to show responsibility towards each other’s health (Brainbench 2003). Again, the privacy or rather freedom given to each one of him or her should be enough to let satisfied working in the area. As such, many companies have made an extensive effort in ensuring compliance with the company codes of conduct that may justify punishing or avoiding some employees as far as such motives are mean to produce a maximization of consequences or results in the production.

Furthermore, other companies have made a decentralised compliance on ethical codes of conduct that have a multicultural aspect. Ban on smoking and other critical health issues at work places have been significant as it does not just touch on the privacy of the health and privacy of a worker, but the integrity. The numerous numbers of cultures that constitute the company employees have an ethical aspect on the cultural norm, which puts the company at task to observe safe work place with considerable concern on ethics.

The Value of Employees

Today the value of employees in any organization is of increasing concern in the world; New York is not an exception. In fact, United States has faced a large number of workforces exiting their companies and searching for greener pastures in an effort to meet their job satisfaction and benefits. However, United States has all along recruited the best in the market in terms of competency abilities and proficiency. Further, the increasing need to employ the best in the market should be backed up by a strategic effort to attract and retain the workforce, which calls for building human resource systems, developing human resources and rewarding human resources consistently over there tenure in the company.

Irrespective of the characterization of the United States n market with voluntary turnover at the senior and middle management levels, Legge (2004) suggests that the use of reporting number of candidates per position for new hires, a level of organizations offering management development programs, companies with an adopted learning strategy and flexibility in proactively staffing prior to market demand, the market still faces stiff global challenges that put it at risk of failure to have a strategic human resource innovation, sustainability and attracting and retaining employees (United States. General Accounting Office 2003).

This paper takes significant effort to assess and evaluate the human resource market trends with respect to the need for strategic human capital management including the ethical, legal and health and safety requirements in light of the competitive challenges in the state of play in New York and recognizes the competencies that the management needs to be strategic planners.

Characteristics of the New York workforce, the human resource environment and the competitive challenges companies face in the New York context.

The labor market in New York is recognized to make strides in an effort to attract and retain valued workers in a highly competitive market. However the New York companies have been able to effectively conduct the first step; recruiting employees but have found it difficult to further attract or retain workers. Yet, the workforce has been a strong motivating factor for guaranteed company development and awareness with respect to implementation of management strategies through managing the human resource environment.

Safe work place

The safety of any work place should be considered according to the risks exposed. This considers the safety which is not measured rather measure of risk. The attended risk has to be acceptable which seems to be ethical. However, the probability of risk is justifies what is acceptable and what is not. Therefore, a reasonable person should consider incorporating a forum of what is acceptable risk. In our consideration, it seems the element of objectivity was not fully considered. The objectivity and violation of the enacted rules to safeguard and enable an acceptable condition for individuals is fundamental in this endeavour.

The enacting of particular smoking zones came since the severity of smoking from any place, especially at working places posed a threat to other employee’s health. The risk undertaken to be controlled has to be necessary. A reasonable and acceptable risk as per Generally Recognised Standards and the notion of prevailing national practice make this possible. Again, professional practices are determined according to how long the issue has been practiced in the market. The nature of jobs comes with its risks, which pushes for one to consider unavoidable risks. As such, one has to undertake the highest possible practical standards and minimal standard of safety where risks are detectable. In fact, detection of adverse effects, through the threshold levels of exposure should be considered (United States. General Accounting Office 2003).

The employer has an obligation to keep a safe environment at the work place. However, whenever an employee does not follow the provisions, the employer ought to authoritatively take ethical action in this regard. As such this paper considers all the effects and exposures to risky areas. In fact, smoking research and development processes have indicated that those people encompassing a smoker’s environment are highly exposed to the side effects of the activity than the smoker him or herself. Therefore, every employee deserves a good work place.

Conclusion
