Edmund Kemper Case

Criminal law may be defined by defining and specifying the consequences of violations or misconducts against the state or society as the whole body of regulations. Criminal law is remarkable in prohibiting behavior and exacting governmental punishment for doing it (Binder, 2016). According to Schmalleger & Hall, “several historical developments and philosophical perspectives have shaped Laws in the United States. Criminal law, in particular, has been dramatically influenced by natural law theories.” (2016, p. 3). Criminal law is generally included in different penal laws. In brief, criminal law specifies prohibited behavior, and criminal infractions are called crimes. Penal law covers the study of criminal defense charges as an academic discipline.

The US serial murderer Edmund Kemper was active in Santa Cruz, California. According to Dunkelberger, he is one of the most infamous serial killers in American history (2020, p. 3). At the California Medical Facility in Vacaville, he is presently serving eight life terms and is regarded as a good criminal. Edmund Kemper “saw how it felt” and killed both of his grandparents. After release, he dropped, collected, and released female hitchhikers. However, eventually, Edmund stopped letting them leave, murdering six young ladies. Then, before returning, he killed his mother and her companion. Kemper is one of the most famous killers, making his biography and court decision enjoyable to analyze.

Early Life

He went to Montana with his mom and two sisters after his parents’ divorce. She was pretty critical of him, and Kemper has a problem with his alcoholic mother, blaming her for all its issues. At the age of 10, she forced him to lie in the cellar away from his sisters, whom she feared he might somehow hurt. There were early signs of danger. Kemper had a terrible fantasy life, occasionally imagining that his mother would be killed. He chopped off his sisters’ dolls’ heads, compelled them to perform a game called the gas chamber, in which he blindfolded them, and brought them to the chair, where Edmund pretended to write agonizingly until he “dead.” He even pulled them out. The family pets were his first victims. One of them was buried alive at ten, and Kemper, the second 13, was killed with a knife. His mother chose to send the troublesome youngster to live with his paternal grandparents in North Fork, California, although he was gone for some time to live with the father.

Grandparents’ Murder

On the farm of his grandparents, Kemper loathed life. He studied weapons before arriving in North Fork, but after numerous birds and other small animals had been killed, his grandparents removed his rifle. Kemper subjected his grandparents someday eventually to his growing wrath. After an argument, the 15-year-old murdered his grandma in the kitchen, and Kemper came outside and shot him beside his car, then hid the corpse when his grandfather came home. He then contacted his mom, who instructed him to call the police and tell them what occurred. Edmund called him. Later, Kemper would explain that “to see what he felt like” he shot his grandma. He said that his grandpa had been slain to prevent the guy from finding out that his wife had been killed. Kemper was sent to the Youth Authority of California for his offenses. He has been subjected to several exams, which have found that he has a high IQ and paranoid schizophrenia. Kemper was later sent for mentally sick prisoners to Atascadero State Hospital.

Release

At 21 years of age, Kemper was freed. Despite recommendations from her prison physicians not to live with her mother due to prior abuse and her psychiatric problems, he rejoined her in Santa Cruz, California, where she had gone to the University of California following her third marriage. During his stay at the community college, Kemper worked in several occupations and finally found work with the Department of Traffic.

The Co-ed Killer”

Kemper took women’s hitchhikers at first and dropped them off. However, they never would get to their goal when he gave a tour to two students at Fresno — Mary Ann Pesce and Anita Luchessa. Their relatives immediately missed them, but nothing of their fate was known until the 15th of August when a lady’s head was found in the forest near Santa Cruz and subsequently found as a Pesce. However, the remains of Luchessa have never been located. Kemper would say later that before Luchessa was killed, he stabbed Pesce and strangled him. He took the victims back to his apartment after the killings and took their heads and hands away. Kemper has also been involved with their bodies in sexual activities. Two additional serial murderers during the killings in Kemper continued to carry on their atrocities in the region John Linley Frazier and Herbert Mullins, leading to Santa Cruz being given the humiliating label “World Capital Murder” by the press. For Kemper, the “Co-ed Killer” and the “Co-ed Butcher” were nicknamed.

Trial and Imprisonment

Kemper went on trial for his actions, accused of eight counts of first-degree murder. All accusations he had been found guilty. When the court asked Kemper what his penalty was supposed to be, he answered he should be put to death. Instead, he was sentenced to eight life terms. Kemper is now serving at the Vacaville California Medical Facility. Kemper is still in jail and is regarded as a model prisoner among the general population. According to the State of California Board of Parole Hearings, “Edmund was also a prominent blind audiobook reader; following a stroke, he withdrew from these roles and became medically handicapped. For failure to give a urine sample, he received his first report in 2016” (2017). He was responsible for planning visits with psychiatrists for other detainees and was a well-known ceramic cop artisan.

Three court-appointed psychiatrists found Kemper legal healthy. One of the psychiatrists, Dr. Joel Fort, studied his young records and the diagnosis of his psychosis at one time. In addition, fort interrogated Kemper, including in the actual serum, and told the court that Kemper had committed cannibalism, saying that he cut flesh from his victims’ legs and then cooked and ate those strips of meat in a pot. However, fort decided that Kemper was fully aware of each instance and said that Kemper had the opportunity to relish the notoriety of the assassin. Later on, Kemper recalled the cannibalism confession.

It should be clear that, for an accused to “create defense because of insaneness,” at the time of the acting, it must be demonstrated that the party charged with the charge worked under such a lack of reason, because of the illness of the mind, without being aware of the character and quality of the act is performed. The primary retention of the M’Naghten formula with the changes proposed will, it is submitted, afford protection to society and include proper solicitude for the individual in the light of our present knowledge, scientific and otherwise. The nature of his actions seemed to be known to Kemper, and he showed symptoms of malice beforehand. Kemper seized the booth on the 1st of November. He claimed that he killed the victims because he was willing to “like possessions for himself,” trying to convince the jury that he was mad. After all, only one with an abnormal mentality could have done his acts. He stated two people lived in his body and added that when the murdering personality took over it, it was like blacking out.”

As a judge, I would take the same security measures in relation to a criminal since he has committed a large number of murders. The trial took place under a protection system that helped Kemper pretend to be mentally ill, although, in fact, he committed all the murders on purpose; this was almost impossible to prove. The court’s conclusion is absolutely fair in relation to this man; he deserves a sentence of eight life sentences.

Conclusion

Criminal law may be described as a comprehensive body of legislation by identifying and describing the consequences of infringements or infringements of state or society. In general, criminal law is contained in several criminal statutes. In short, the legislation outlines forbidden conduct, and criminal offenses are referred to as crimes. Criminal law includes the study as an academic subject of criminal defense charges. American serial assassin Edmund Kemper had been active in California’s Santa Cruz area. Kemper had an awful dream life, sometimes imagining his mother’s death. His history and court judgment are fascinating to examine. Kemper is one of the most renowned killers.

For the accused to “build a defense on account of folly,” it should be apparent at the time of the crime that the charged party operated under such a lack of justification due to mental illness without being aware of the nature and quality of the act. The trial was conducted under a safeguard system that allowed Kemper to pretend that he was mentally ill while purposely committing all of the killings. With respect to this individual, the judge concludes entirely reasonably; he deserves an eight life term.
