Introduction
The issue of piracy has been a hindrance to the economical growth of a country and also the industries within a country. For this reason, many countries have resulted to formulate policies that will restrict the entrance of pirated goods into the market, therefore, cutting the level of piracy. By this, stakeholders have been involved by governments in the implementation and formulation of policies that govern a country’s market economy.
Policies towards Piracy in Kenya
Industrial Property Act – This law was implemented to ensure that the industrial property laws in Kenya were in line with TRIPS.
Copyright Act takes into consideration the mechanisms, administrative and structure enforcement of rights related to copyright (State Law office, Republic of Kenya, 2001).
Seed and Plants Variety Act – This act is used to provide certification of seeds thus is also used to impose restrictions on the variety of seeds (Seeds Quality Control Services).
Trade Marks Act – This policy provides services through appointments done by the registrar of Trademarks who is currently administered under the Industrial Property Institute.
Trade Descriptions Act – Being the policy that is used in most fights involving counterfeit and piracy, the policy prohibits misdescription of goods and services as which are in occurrence within the lines of trade. This is done to restrict the false and/or misleading information on prices of goods et cetera.
Weights and Measures Act – Though this policy is limited to counterfeit and pirated goods, it has been used to ensure that the right measures provided on descriptions of goods and services are true and that do not bear false information on the quantity of packaging.
Take into Account the Policies towards Piracy
In this regard, the consultant and the firm in question will have breached the rules of piracy and counterfeit and therefore liable for all the loss made by our company. It is therefore important to take keen consideration on the laws that concern the relative field of piracy thus sue the company. The company will be charged with respect to breaching the Trade Descriptions Act, the Weight and Measures Act and the Trade Marks Act. With this in mind, the company will have to explain why it offers sub-standard goods and services to consumers in the market hence causing our company to suffer massive losses due to foul play.
Effects of the Economic System that Characterize the Country Due to the Firms Action on the Protection of Intellectual Property
Many effects related to the actions taken by a firm will positively affect the Country as legal procedures will have to be followed and this means that the firm and the government will rescue the billions of dollars that go down the drain annually. By doing so there will be significant changes in the firm as there will be improved stability within the market environment. This means that through authenticity the company will sell goods and provide services that are worth the amount paid for; this will help the company sell and gain the profits it requires through perfection. This means that a firm may also retain to have sole rights to produce/manufacture certain products whose composition is kept as a secret within a firm.

It is of the utmost importance for firms to abide by the regulations put in place so as to avoid the breaching of rules and regulations. For this to happen, countries must work in co-operation so as to eliminate the issue of piracy and counterfeit within the World market. This should also include the involvement of the private sector. By doing this, billions of dollars will be saved Worldwide which occurs as a result of counterfeit and Piracy.
