Customers from automotive parts manufacturers, department of defense, aircraft manufacturers, beverage makers & bottlers, and alliance manufacturers are served by Riordan’s employees. The company has also flourished due to the customer care it provides. The affairs of the company in accordance with the article of incorporation and other relevant laws are fully executed by the board of directors.
The Riordan Corporate Compliance Plan will serve as a guide on how the company will handle current and future issues on legal matters relating to officers and directors of Riordan, enterprise liability, real and intellectual property, governance principles, and the specific international laws that must be adhered to by Riordan employees.
Mission statement
By using the Six Sigma business management strategy and being on the leading edge in the use of research and development (R&D) tools, Riordan has earned its certification under ISO 9000. This defines the company’s ability in realizing all their goals in the manufacturing sector.
As an industry, they are able to stand up to the challenges brought about by customers in the different lines of production. Their R&D enables them to determine the current trends in the market that are relevant in increasing customer satisfaction.
Employment and labor
The organization needs to maintain well informed, creative and a supported team of employees so as to always ensure the viability of the company. Compliance with local and international authorities aids in the protection of Riordan employees as well as the environment they work in.
These laws are laid out to prevent violations of any rights. Riordan works in line with labor laws and statues to ensure employee safety in the workplace environment. People who have valid green cards and work permits are given an opportunity to be employed by the company.
Discrimination against protected groups should not be prevalent in public companies as outlined in Title VII of the Civil Rights Act of 1964. Riordan prohibits employee discrimination on the basis of race, color, religion, sex or national origin. Supervisors, directors, and other officers should be selected and appointed on the basis of their qualifications.
This will improve the quality of service delivery as well as reduce chances of discrimination. Annual conferences should be organized in order to remind every individual of their legal responsibility in relation to the subject of sexual harassment and fair treatment to all employees.
Alternative dispute resolution
Whenever disputes or conflicts arise among Riordan employees, the alternative dispute resolution (ADR) technique is used to resolve them. The employee is subject to litigation in cases where they block an investigation or have engaged in illegal activities. In cases where the dispute has a direct bearing on the welfare of the organization, the employer covers the expenses incurred.
The use of the ADR tool minimizes the risk of court cases. Every employee in the company has a supervisor who is in charge of handling all the complaints reported. The supervisor helps in resolving these issues. However, if the employee feels that the supervisor has not adequately solved their problem, they can directly call the compliance hotline through their phone or contact the hotline response team via email.
Informal mediation is also another process of resolving disputes in the company. The mediator facilitates the dispute process by providing a neutral and safe environment for the dispute to take place. The mediator neither takes sides nor provides legal advice. Once a decision is reached between the disputing parties, the mediator writes it down and files the conclusion for records.
The case may then be presented to the peer review committee where the two employees are given an opportunity to request for an advocate. This advocate will argue on their behalf before the case is heard by a panel of five neutral parties. The employees will then reach an agreement that is signed by the panel and is then documented by the mediator.
Enterprise liability
According to the tort law, an entire organization can be held responsible for the offences committed by its constituency. This is referred to as enterprise liability. Ethical responsibility from the directors of Riordan is important to prevent them from breaching the law.
Ethical trust exists between Riordan Manufacturing and its officials. To maintain documentation of all the employees, the directors have the permission of investigating matters that could lead to a breach of conduct.
Taking part in illegal activities that could jeopardize the company is strictly prohibited. The board of directors has a duty of providing a clear and transparent platform for the officers to conduct their duties to avoid breach of law and subsequent prosecution.
Product liability
Riordan Company works in conformity to the state, federal, and international regulations regarding the products manufactured. The company has a quality measurement test that ensures its products attain the set standards. The legal department is in charge of evaluating all the consumer complaints that may arise.
All the officers check the production units to ensure that the organization follows the federal trade commission. Products that may have defects are reported immediately to the relevant officials. Safety issues regarding the products are also pointed out and documented accordingly.
International law
Riordan manufacturing shall work in conformity to the laws of the country. In addition, the company will adhere to the regulatory bodies of the countries which it does business with.
The organization will also adhere to international guidelines stipulated by bodies such as CISG (Contracts for the International Sale of Goods), GATT (General Agreement on Tariffs and Trade) and the World Trade Organization. By failing to violate these laws and regulations, Riordan will ensure that it doesn’t engage in trade activities that jeopardize its commercial ties with international organizations.
Real and intellectual property
One of the mandates set aside by federal and state law enforcers is to protect intellectual property rights from infringement. It is the duty of Riordan’s management to ensure that the company’s intellectual rights are not violated. In case of such occurrences, the company officials should be aware of the procedures set aside by federal and state laws which should be followed to the letter.
For instance, before reporting any incidence of a damaged property, a damaged property report needs to be drafted which includes the names of the staff members that were present at the time the incident occurred that may or may not have participated in it.
Transfer of property from the organization to third parties or vice versa should be well documented and analyzed to ensure accuracy. Cases of stolen property will be investigated and relevant authorities may be called to carry out these investigations. Employees and other staff members who are found guilty of such activities will be handed over to the authorities for further questioning and legal action.
Governance
Riordan is compliant with the Sarbanes-Oxley Act of 2002, a United States federal law which set new standards for all public companies in the USA. The goal of this Act is to enhance rules regarding corporate governance.
It also alleviates the likelihood of conflicts of interests and enables investors and customers gain confidence in the organization. By conducting the company’s activities in accordance with the Sarbanes-Oxley Act, the management of Riordan ensures that business is run in the best interest of all stakeholders. Governance is also applied in the area of risk management within the organization.
Issues regarding the creation of policies and any other documentation are also subject to governance. Riordan always strives to ensure accountability and transparency in the way they conduct business. The laying out of the compliance plan will be the duty of the officer in charge of compliance.
Employing the corporate compliance plan is inevitable for Riordan Company. This not only protects the employee and its environment, but also ensures the viability of Riordan as a company as it competes with other companies in the manufacturing industry.
