Employee Participation in the Netherlands Essay

Introduction

Employee participation with regional laws and standards is an issue, which constantly is confronted by organizations that experience overall reorganization. Evaluating these laws and standards often becomes a matter of first concern in order to prevent any postponements in the application of primary choices of business. This essay provides the information about the essential elements of the deliberation actions regarding employee participation in the Netherlands. Moreover, an assessment of current and future employee participation will be evaluated.

The interests of workers in the Netherlands regarding engaging the company they are employed in are regulated in certain constitutional laws. WCA, which is short for the Dutch Works Council Act, is the most prominent among them. In was established in 1971; by its regulations, the Ondernemingsraad (the workers’ representative council) is granted with a chance to criticize the particular influential organizational and trading agreements (Nunes 2009). Moreover, for certain decisions the guidance from Ondernemingsraad is an obligation. Dissimilar to the regulation of other nations, the rules of the government of Netherlands do not obligate the workers to participate in the works council; nor do they empower it to influence the allotment of the income.

Unions of Employees

There are several standards of association of the workers: a company union, a general union, a craft union and a federation (Assignment MO33 ILR 2015). Below we will provide a table with current unions and its member in the Netherlands.

According to the various researchers, the current rate of employee participation in the work unions in the Netherland is slightly more than twenty percent (Netherlands 2014). A typical association includes nearly 15 thousand of representatives. Moreover, all organizations ultimately in the combined sum of every union merge about 1,7 million out of 7,4 million existing workers.

Work Councils

“The works council consists of representatives who are elected directly by the employees from their midst. The framework of the election procedure is set out in the WCA” (Works councils in the Netherlands 2014, p. 4). The quantity of the members of the work council is a value, which is dependent on the total number of workers in the organization:

The workers who had been with the company for at least half a year obtain the ability to choose the candidacies and elect representatives to the council. “The election will take place by means of a secret ballot on the basis of one or more lists of candidates. A list of candidates may be presented by a recognized trade union, which has operated for at least two years as a legal entity and which aim is to support the interests of its members” (Works councils in the Netherlands 2014, p. 4). The recent researches indicate that more and more people annually are willing to join company unions, while the quantity of the work councils remains the same due to the particularities of the election procedure.

Conclusions and Recommendation

In this essay, we have observed and evaluated the estimate of the workers’ participation in the Netherlands. The information about the current participation rate of employees in wok unions and councils was presented, as well as basic regulations of employee participation. An accurate and detailed formation of papers along with an acceptable schedule would lead to a prevention of lawsuits and an encouragement of the efficient application of business-related agreements in the Netherlands.
