Introduction

Juvenile crime refers to the criminal act of a minor who is under the age of eighteen and is considered to be unendorsed by a matured protector (Juvenile Crime, 2006). The juvenile justice system has creative methods to defend and recuperate errant kids. But regardless of this, it has evolved cruel punishments including capital punishments to be given to these children. Judicial system of the juveniles is designed with a varying concept where the thought and activities of the youngsters are different from those step follwed in adult prisons. It is evident that the judicial system in a state is intended for the total well being of all the people. At the same time, the fundamental aim of the judiciary is to encourage and stabilize the young generation in a society.

Considering this aspect, the juvenile law has been set up with lots of leniencies. The state itself takes the responsibility to help the youth through counselling and better educational prospects. The aim of the judicial systems is to keep the juvenile distanced from committing further offence. To achieve this object, a juvenile’s family ought to be included in the awareness programs meant for these young people (The Juvenile Justice System). Studies reveal that the aggressive felony committed by juveniles is nearly at par with those of the adults. Still the judicial structure considers them in a different way and it is constituted to consider the safety of the juveniles.

Most probably, the verdict of the court, in spite of the ruthlessness of the crime, is towards creating a better surrounding for the juveniles to lead a virtuous life in the future. While comparing adult punishment, the judgment of a juvenile offence is based on the nature of the crime (Juvenile Crime, 2006). Moreover, as a part of sympathetic consideration, analyzing their personal tribulations, treatments like psychiatric medication as well as fine tuning family interactions are also encourages to assist the change of a juvenile’s personality. By that time the juvenile will be given amenities for self sufficiency and recovery. Homely atmosphere plays a vital role in molding the character of a child. There are several factors that attribute to the commitment of a crime by a child. Deprivation of the parental love is one of the main factors that induce juvenile crime in the society. Besides, the most imperative subject matter for the society taken as a whole is to compensate for the inadequate care by families and endow juveniles with assistance and direction. Presently, some argue that in the past some juveniles who were shifted to adult court frequently obtained relaxed dealings, current researches provide evidence that this system is more penalizing in nature.

Whenever they have to move to adult court, they have to face more callous, strict, speedy and, rigorous punishment than that they have undergone in the juvenile court. The Amended Juvenile Law points out that incase a juvenile is sixteen or over and commits a crime of murder the juvenile is not referred to the public prosecutor but punishments except capital punishment is given to the juvenile. This is only in circumstances where there arises the need to analyze the intention behind the crime, state of affairs after the offense, traits of his character, age, conduct and other milieu. Criminal behavior of the juveniles ought to be checked and to substantiate this effective and austere procedures are required from the side of the judicial system.

Unless juveniles are reared properly, they will get demotivated and result in atrocities (Juvenile justice system. 2005). Creating institutions like juvenile homes alone will not serve the purpose of transforming a juvenile into a righteous human being. Parents should pay continuous attention on children to avoid criminal instincts that might arise in the criminal traits of a person. It is recommended to approach the juvenile with better understanding and compassion.
