The Code of Ethics
The UN Code of Conduct for Law Enforcement Officials is a document that was adopted by the General Assembly Resolution 34/169 of 1979. It encapsulates their responsibilities, their ethical duties, and their need to prevent any violation of the code of conduct. Moreover, the file reviews such aspects as confidential issues, punishment, and the ban on degrading punishment and treatment (UN Code of Conduct, 1979). This is why it is a rather crucial document to this day and serves the purpose of preventing any ethical and international violations of various legislations and legal projects. The Code is applicable to all countries that are a part of the United Nations, including the United Arab Emirates.
Implementing a Similar Code Within the MOI Code of Conduct
In order to implement a similar code within the MOI and the Abu Dhabi police, I would do research, make plans for the code, and evaluate it. I would review various aspects of the two organizations, such as their responsibilities, disciplinary measures, and their hierarchy. I would take into consideration that the MOI deals with police and protects state security, while the Abu Dhabi Police provides policing services to the country (UAE.en, n. d; Development Aid, n.d.). This would explain how I need to structure my code. Then, in accordance with the acquired data, I will plan and implement certain articles in the code regarding issues such as code obedience. For example, I would accentuate the duty of these organizations to report any violations of the code, with disciplinary actions depending on the severity of the offense. Finally, I will review the code I implemented for any possible drawbacks and advantages. I will assess the severity of the drawbacks and the weight of the advantages in order to understand how it may affect the value of my code.
Drawbacks and Advantages of Having Such a Code in the MOI Code of Conduct
Unfortunately, some drawbacks are very likely, as it would have been a newly implemented document. One of the main issues of the possible implementation is disciplinary measures. Currently, a lot of the disciplinary actions in case of violation include wage deduction, suspension, and even imprisonment, depending on the severity and nature of the misdeed (Federal Law, 1977). Second, there may be some issues in the process of implementation. Second, one of the issues of the implementation is that the punishment may be even more severe than in other areas, as the UN Code it is based on requires this. However, the advantage is that it will require officials to report any violations within the chain of command. That way, it will be easier to ensure control over the discipline within the MOI, while respecting its rules and regulations that may be stricter. Thus, the document should be written thoroughly and with consideration of the organization’s mission and features.
Conflicts and Challenges in Having Such a Code in the MOI Police
The flaws in the plan are tied to its adaptability to the country’s needs. For example, it should take into consideration such aspects as duties and discipline. According to Federal Law, police members are to obey higher-ranking colleagues, and fulfill their assignments (Federal Law, 1977). However, they are not allowed to provide data on confidential issues, even after they leave the occupation. Currently, it states that if required, a criminal or civil lawsuit may be filed against them. Although both codes are opposed to the disclosure of confidential information, it is debatable whether the punishment would become harsher or softer. Currently, the disciplinary actions in the law range from a warning notice and a salary deduction to rank deprivation and expulsion. Since the UN code is unclear about the specific disciplinary actions that need to be taken, this concerning measure is yet to be reviewed.
Addressing These Issues
I would have discussed those issues with the high-ranking officials in the MOI and the Abu Dhabi Police as a means to come to a suitable solution. They would tell me about some of the changes that I would need to make for this code and some aspects that I need to consider more thoroughly. Meanwhile, I will need to ensure that the code that I will implement prevents any sort of ethical, legal, or moral issues. Moreover, I will need to be attentive to the needs, features, and discipline of the MOI and Abu Dhabi Police. That way, with the help of these actions, I will be able to not only address the aforementioned issues but form a constructive and cooperative dialogue between myself and the two organizations, ensuring that the implemented code will be followed.
