The prosecutor’s case analysis

The prosecutor in this case has a legal responsibility of determining whether the case is worth hearing in a court of law or not. The determination will depend on the strengths and weaknesses of the case as presented to the prosecutor by the detectives. This is a consideration of a case presented by Detectives Smith and Jones regarding a murder case involving Sally Thomas, a Big State University student, who was the victim and John Brown; her boyfriend and also the suspect.

Strengths of the Case

The body of Sally Thomas was found nude on the bed. This gave a literal impression that there was a high chance of a mutual interaction between the deceased and a male prior to the incidence. This might not have been Mr. John Brown parse. John was a prime suspect in this case because the deceased was last in a relationship with him and she was never seen with another man prior to her death. This is one very important circumstance that is considered as strong evidence by the prosecution.

The DNA profile that was developed from the semen recovered from Sally’s reproductive organ matched John Brown’s; her boyfriend. This gives the case a weighty legal argument in favor of the prosecutor. The DNA results obtained played a significant role in linking the accused to the crime. It is important to note that every human DNA is distinct and, therefore, there are no chances that the suspect shared DNA with another man who might have had intercourse with Sally just before her death.

A towel recovered from Sally’s dining room had blood stains that were proven as hers. This indicated that the murderer had dropped the towel after cleaning off the blood stains from his body. The investigation team recovered sample cells from the towel and tested their DNA. The samples were set in two profiles. The first profile gave a 50 percent match to John Brown whereas the other sample gave 50 percent match to another unknown man. Further inquiries about John Brown from his peers also gave shocking results. The investigative team that sought to know his characters from his friends discovered that his schoolmates and teammates knew him as a hotheaded man who had no respect for women. Therefore, it is probable that John might have had a hand in the murder.

Weaknesses of the Case

The prosecution is not in a position to ascertain the details of the events prior to the incidence. Being that Sally and John were in a relationship at the time of her death, it is difficult to pin her death on John. This is because they might have had sex long before her death. It is then possible that the two, Sally and John, may have reconciled and had voluntary sex hours before the unknown person broke into Sally’s home. The unknown man must have then tried to rape Sally before killing her. Similarly, the case of the DNA of the cells recovered from the towel may be true as proven, but John may have used the towel hours before the incident because he was welcome to use Sally’s towel as her boyfriend.

Recommendations

However, since the case presented is weightier on the strengths than on the weaknesses, the evidence is sufficient enough to warrant the arrest of the suspect, who in this case is Mr. John Brown. This is inconsiderate of the effect the arrest would have on his career.
