Even though healthcare in the United States aims to help people with mental and physical problems, negligence and defilement of medical rules can happen. According to Robinett (2019), medicine and politics are closely related, and the quality of assistance might be decreased due to the difference of views. Based on the case study about a 61-year-old SK, a significant number of standards of care were violated, and the patient’s family can seek help in court, which should follow the Nurse Practice Act in the state of Florida.
One of the main standards of care across the United States, specifically in Florida, is the patient’s ethical relationship. Leider et al. (2017) state that violation of ethical frameworks may cause disasters in response to urgent issues. The case study explains that the patient’s family tried to reach nurses and ensure specific breathing tests that would predict the development of pneumonia, but due to the shortage of staff, the response time decreased. This problem is a common example of standard disobedience in ordering diagnostic tests. The Nurse Practice Act of Florida supports the side of the patient in this case (Cypher and Kosycarz, 2017). The court might conduct additional investigations to defend SK’s rights or provide compensation to the family.
Another care standard that is crucial in the medical industry is regular control of the patient’s condition and quick response. The case scenario states that for the last 51 days, there was a critical shortage of nurses, and it was complicated to control all patients in the department. The Nurse Practice Act of Florida says that all patients and their families can receive urgent protection when they are looking for care (Cypher and Kosycarz, 2017). The hospital did not follow this point and the outcome was not favorable.
