Immigration of people to other countries has been on the rise in the recent times. The search for green pastures abroad remains the major reason for immigration. Almost every country around the world has formulated immigration laws to checkmate influx of people into their countries.
Immigration of men and women continues to be on the increase in developed countries, and immigrants’ rights are grossly abused from time to time.
These countries have imposed strict policies against immigrants that is why Human Rights Watch and other Non-Governmental Organizations have condemned the violation of the human rights. In whatsoever situation an individual finds him/herself, the infringement of his/her rights is globally condemned.
The governments have tried to implement their policies on immigrants which would be in line with those by the Human Rights Watch. There have been so many arrests and deportation of immigrants; moreover, death cases have been recorded. Records show that the situation has reached an alarming rate, and a global condemnation has continued to be publishing.
In order to solve the problem of violation of the human rights of the immigrants, some recommended policies include:
- The detention of immigrants should be reviewed on a regular basis, and if a person is to be detained, it should not last for more than three weeks.
- The detention of a person will be implemented only if all other available measures used in handling such a case are exhausted.
- The cases of child detention should be treated within two days, while children should not be detained in any detention centers.
- Those immigrants who have been detained in any of the detention centers are to be prosecuted using fair actions. In addition, these actions should not violate human rights.
- The detention camps will be well taken care of. In other words, detention camps should be habitable.
- The court should fairly try any detained immigrant, and he/she should be given access to the federal law courts.
- These policies should be enacted at the international level, and corresponding penalty is to be given to governments that are found wanting.
More have to be done starting from the local level up to the national and even international one. Although governments have insisted that immigrant’s rights are protected, much is yet to be done in the discharge of such mandate. The courts remain the best arbiters for such violation. Policies guarding immigrant’s rights are to be enforced by an independent organization in any country.
The law that makes it difficult for immigrants to go to federal courts and seek to redress on abuse should be abolished. This will assist in maintaining a level of transparency that governments have talked about.
The Human Rights Watch has to be established on the international level, and it should be independent from any government so that its powers will be fully utilized in implementing its objectives. If the organization really wants to protect immigrants’ rights, it should setup offices that will be responsible of protecting immigrants from any form of abuse.
Finally, rights of these migrants will be violated if good policies are not enforced. It has become an international call for justice. Nothing has been done on this issue because governments are afraid of possible explosion of their population due to immigration. Governments believe that unless these measures are harsh on migrants, it will affect their economy.
